Terms of Service

These Terms of Service ("Terms") govern your use of the SimUser AI platform and services provided by SimUser AI LLC ("SimUser AI", "we", "us", or "our"). By using our service, you agree to these Terms.
1. Acceptance of Terms
By accessing or using SimUser AI, you agree to be bound by these Terms and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Service Description
SimUser AI provides AI-powered beta testing through synthetic personas. Our service includes automatic flow discovery of your web applications, AI persona-driven testing with behavioral profiles, experience reports with NPS scores, quality grades, and qualitative feedback, and integration with issue trackers, communication tools, and CI/CD pipelines.
3. Accounts & Access
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. We reserve the right to suspend accounts that violate these Terms.
4. Credits & Billing
SimUser AI uses a credit-based pricing model. Credits are consumed when AI personas execute test flows against your applications. Unused credits roll over according to your plan terms. Credit packs can be purchased for additional usage. Billing is processed through Stripe. All prices are in USD.
5. Application Credentials
When you provide application credentials for testing, you represent that you have authorization to test the application, the credentials are for a testing or staging environment, you will not use the service to test applications you do not own or have permission to test. We encrypt all credentials with AES-256 and store them in AWS Secrets Manager. Credentials are never logged, exposed, or transmitted to AI model endpoints.
6. Intellectual Property
You retain all rights to your application data, screenshots, and test results. SimUser AI retains rights to the platform, AI models, persona engine, and all proprietary technology. Experience reports generated by the service are owned by you and may be used freely within your organization.
7. Prohibited Use
You may not use SimUser AI to test applications without proper authorization, attempt to reverse-engineer the AI persona engine, use the service for competitive intelligence gathering against other SimUser AI customers, exceed rate limits or abuse the platform, or share account credentials with unauthorized parties.
8. Limitation of Liability
SimUser AI provides testing insights and feedback generated by AI personas. This feedback is advisory in nature and should not be the sole basis for product decisions. We are not liable for bugs or issues not detected by AI personas, business decisions made based on AI-generated feedback, downtime or service interruptions beyond our reasonable control, or indirect, incidental, or consequential damages.
9. Termination
Either party may terminate the service at any time. Upon termination, your data will be retained according to your retention policy (default 30 days) and then permanently deleted. Unused credits are non-refundable unless required by applicable law.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, United States. Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
